§7104 NOTIFICATION
Must be filed for products to be SOLD in the state after:

July 1, 2006

§7105 RESTRICTION ON THE SALE AND USE OF CERTAIN MERCURY-ADDED PRODUCTS

Products cannot be SOLD after:

(a) Novelties - No restrictions on novelty products with button cell batteries or mercury-added lamps

July 1, 2006

(b) Thermometers and thermostats- No exemption allowed

July 1, 2006

(c) Dairy Manometers- No exemption allowed

January 1, 2006

(d) Elemental Mercury - Certain exceptions

July 1, 2006

(e) Instruments, Measuring Devices and Neon Signs
Cannot be SOLD in the state unless sale approved under exemption process **

January 1, 2007

(f) Mercury switches and relays
Cannot be SOLD in the state unless sale approved under exemption process **

January 1, 2007

(g) Exclusion for existing equipment

In use prior to January 1, 2007

(h) **Exemption application deadline for switches, relays and measuring devices.

§7106 LABELING OF MERCURY-ADDED PRODUCTS

  • Button cell batteries exempted
  • Label product, component & package
  • Labels - legible, 10 point font, clearly visible, durable
  • Prior-to-purchase visible label

Products SOLD after
July 1, 2007

(Replaces 10 V.S.A. chapter 159 §6621d)

Alternative Labeling (h) - Only if strict compliance of standard labeling cannot be met. Submit request prior to labeling plan to obtain alternative approval number to include on certified labeling plan form.

  • Alternatives approved for FONT size less than 10 point font prior to July 1, 2005 will remain in effect until July 1, 2015.

 

Specific Product Labeling (i)

  • Large appliances (1) - product and component label
  • New motor vehicles (2) - door post label only
  • Products with non-replaceable lamps (3)(A) used for specific purposes - product and care & use manual
  • Products with LCD screens less than 7" in diameter (3)(B) - care and use manual only
  • Products with replaceable lamps (3)(C) - product, package, component, care and use manual or product instructions, if any, and on housing if any

Products SOLD after
July 1, 2007

  • Labeling of flashlights or portable lanterns (4)

July 1, 2009

  • Deadline for submission of certified labeling plan (j)
    Updated Plans must also be submitted if there is currently a plan on file.
